Is Apple and Fortnite Still Fighting?
The long-drawn battle between Apple and Fortnite seemed to have finally reached its settlement. However, is the fight really over or is there more to come? Yes, Apple and Fortnite may have seemingly settled their differences on the surface, but the conflict underlying the situation is far from over.
Federal Appeals Court Upholds Apple’s Dominance
In 2020, the Apple-Fortnite controversy had reached new heights when Fortnite Epic Games decided to challenge Apple’s App Store policies. Epic allegedly bypassed Apple’s guidelines in an effort to avoid the tech giant’s 30% commission fee on every in-app purchase. Apple, not approving of the actions, removed Fortnite from their App Store, resulting in Epic submitting an antitrust lawsuit seeking to declare Apple an unreasonable monopolist.
In September this year, the federal appeals court finally spoke, siding with Apple (AAPL) in a heavily anticipated verdict. The ruling exonerated Apple of monopolaristic behavior, deeming their practices reasonable. On the contrary, the court opined that EpicGames had been exploited the loophole in the rules intended for genuine game development experimentation.
But, Has Battle Really Ended?
So is the battle finally over? Not as simple as that. While Apple wins the antitrust suit as a major victory, Fortnite parent company, EpicGames has not ceased its protests regarding Apple’s store policies. The conflict isn’t simply about a 1% commission, but rather an unresolved issue on the fundamental rules driving the App Store, specific to game development.
Epic Games maintains that these existing rules force developers to make ‘onerous’ choices and stifles the competitive landscape in video games, potentially limiting their development and innovation potential. By questioning the 30% commission rate alongside the strict regulations, EpicGames sees this struggle in the pursuit of fair business deals and opportunities among developers and consumers alike.
Other developers too, may possibly be encouraged by Epic Games fight, taking cues to fight over similar unfair practices.
- Tie-up Between Apple and Developers at Stake
In response, in an open letter, Epic requested Apple for a chance "to play fair," stressing that 30% commission and regulations should reflect actual labor and resources required for a team to design, create, implement, and deliver a new console-quality experience. Fortnite argues that developers of console-level games, with limited resources, could be forced out by costs and unfair competition from tech giants with more capital influence.
By doing this kind of business, Fortnite wants more developers to contribute toward the gaming sector and ensure sustainability.
